Copyright process

DMCA notice and counter-notice.

This process applies to claims under 17 U.S.C. § 512. Ordinary plagiarism concerns or disputes about authorship, credit, payment, or contracts are not necessarily valid DMCA notices.

How the process works

  1. MobWriter reviews each submission for substantial compliance. If a notice identifies the work and material and provides contact information but is incomplete, MobWriter will contact the sender or take other reasonable steps to obtain the missing elements.
  2. For a substantially compliant notice, MobWriter acts expeditiously to remove or disable access and takes reasonable steps to promptly notify the affected user.
  3. The affected user may submit a compliant counter-notice. MobWriter promptly forwards it to the original claimant and states that access will be restored in 10 business days.
  4. MobWriter restores access not less than 10 and not more than 14 business days after receiving the counter-notice unless the designated agent receives notice that the claimant filed a court action seeking to restrain the alleged infringement.
  5. MobWriter preserves the case timeline and may disclose information when required by valid legal process.

Repeat-infringer policy

MobWriter records valid takedowns, removals based on apparent infringement, and court findings. Reversed or mistaken events do not count. MobWriter ordinarily terminates an account after three active infringement events within 12 months, but may warn, restrict, suspend, or terminate earlier for deliberate, severe, repeated, or evasive conduct, or decline termination where documented circumstances show it would be inappropriate. Terminated users may not create replacement accounts. MobWriter accommodates and does not interfere with applicable standard technical measures. Staff must document every counted event and account action and apply this policy consistently.

Submit a takedown notice

Only a copyright owner or authorized agent should use this form. Consider fair use and other lawful authorization before submitting.

Your submission and contact information may be forwarded to the other party. Knowingly making a material misrepresentation may result in liability under 17 U.S.C. § 512(f).

Submit a counter-notice

Use this only after MobWriter disabled your material and provided a DMCA reference code. This is a legal request to restore material allegedly removed by mistake or misidentification.

Your submission and contact information may be forwarded to the other party. Knowingly making a material misrepresentation may result in liability under 17 U.S.C. § 512(f).
