2. Agreement to the Terms
By creating an account, checking an acceptance box, submitting content after an action-specific notice, or otherwise accessing or using the Services, you agree to these Terms and the policies expressly incorporated into them. If you do not agree, do not use the Services. Some legally significant actions may require a separate confirmation tied to this Terms version, and acceptance records may include your account, action, story or contribution, timestamp, version, and text hash. If you use the Services for an organization, you represent that you have authority to bind it.
3. Who Operates MobWriter

4. Eligibility and Minor Users
You must be at least 13 years old to use the Services. If local law requires a higher minimum age for us to provide the Services without parental consent, that higher age applies. If you are under the age of legal majority, your parent or legal guardian must review and agree to these Terms on your behalf where required by law. NSFW content and settings are available only to signed-in users who are at least 18. You must provide accurate age information and must not evade age controls.
5. Accounts and Account Security
You must provide accurate information, keep it current, use only an account you are authorized to use, protect your credentials, and promptly notify contact@mobwriter.com of suspected unauthorized access. You are responsible for activity through your account unless caused by our breach of these Terms or duties imposed by law. We may require verification before restoring access or processing a sensitive request.
6. Description of Services
The Services provide tools for creating, reading, publishing, and collaboratively editing stories; proposing, reviewing, withdrawing, rejecting, merging, and directly publishing edits; managing collaborators; maintaining versions; interacting with content; and reporting concerns. Public or private visibility controls access and does not change copyright ownership or licensing. Authenticated users may propose edits to public stories. Access to one private story does not grant access to another.
7. User Content and User Responsibility
“User Content” means material users upload, create, submit, publish, transmit, or make available through the Services. You retain the rights you hold in User Content, subject to permissions granted in these Terms and the rights of others. You are responsible for obtaining all rights, permissions, releases, and consents needed for it. Visibility controls are not a confidentiality agreement.
8. MobWriter's Service-Operation License
You grant MobWriter a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, process, format, transcode, resize, crop, transmit, display, and otherwise use User Content as reasonably needed to operate, secure, improve, moderate, promote, and provide the Services; comply with law; and exercise or defend legal rights. The license follows visibility choices except where access is needed for authorized collaboration, moderation, security, support, legal compliance, or records. It may continue for backups, history, merged works, legal holds, safety records, and copies made by others. It does not transfer copyright to MobWriter.
9. Public Content and Promotional Use
If you make User Content public, you authorize MobWriter to display it publicly and use reasonable excerpts, thumbnails, story titles, covers, usernames, and attribution to identify, link to, and promote that content and the Services without payment. We will not knowingly use private story text in public advertising without separate permission. Third-party copies and caches may remain after visibility changes.
10. Story Ownership and Publication Licenses
A story owner controls the story page, visibility, collaborators, editorial decisions, and publication through the Services, but does not automatically acquire another person's copyright by owning the story record. All stories use an All Rights Reserved designation. Public or private visibility does not alter it, grant rights in third-party material, excuse infringement, or override these contribution permissions.
11. All Rights Reserved Stories
Except for rights expressly granted by the applicable rightsholder or allowed by law, users may not reproduce, distribute, adapt, publish, sell, license, or exploit an All Rights Reserved story. Reading a public story or accessing a private story does not grant a general reuse license. MobWriter does not register copyright, verify title, or guarantee that a claimed owner owns every element.
12. Fanfiction and Third-Party IP
Fanfiction and transformative works may use third-party material. Labels, disclaimers, noncommercial status, and attribution do not by themselves make a use lawful. You are responsible for determining whether your use is authorized by permission, license, or applicable law. MobWriter does not provide legal clearance and may restrict or remove content in response to complaints, orders, risks, or policy concerns.
13. Contribution Submissions
A “Contribution” is a draft, proposed edit, direct edit, or other material submitted for possible inclusion in another user's story. A “Merged Contribution” is incorporated into the canonical story through owner approval or direct publication by an accepted Editor authorized to publish without separate review. Submission authorizes the owner, authorized editors, and MobWriter to access, review, copy, compare, annotate, moderate, and preserve it. This limited pre-merge permission does not authorize publication as part of the story unless merged or directly published under Section 15.
14. Rights Before Merge
You retain copyright in an unmerged Contribution. Until merge, the owner may review it but does not receive the broader Section 15 license. You may withdraw an eligible Contribution before merge while the feature permits. Withdrawal does not require deletion of security, moderation, notification, backup, legal, audit, or other lawfully retained records.
15. Rights Granted Upon Merge
When an owner accepts and merges your Contribution, or you use an accepted Editor role to publish directly after the action-specific Terms notice, you grant the owner and MobWriter a worldwide, perpetual, irrevocable to the extent permitted by law, non-exclusive, royalty-free, sublicensable, and transferable license to reproduce, edit, adapt, combine, create derivative works from, publish, display, perform, distribute, preserve, and otherwise use that Merged Contribution with the story, its promotion, and its version history in any media. This license survives account deletion and later revision. It does not by itself assign your copyright or make the owner the copyright owner of your original contribution.
16. Later Editing of Merged Contributions
You authorize the owner, authorized editors, later authorized story controllers, and MobWriter to revise, rearrange, abridge, expand, combine, remove, restore, reformat, or otherwise edit a Merged Contribution as part of the story and history. Removal from the current version does not revoke permissions for earlier versions, backups, records, moderation evidence, or other authorized uses.
17. Attribution and Editorial Control
MobWriter may display attribution using your username, display name, account identifier, or an anonymized or deleted-user label. Attribution may vary by feature, formatting, moderation, deletion, and technical limitations. The owner has final editorial control over Contributions, subject to these Terms and law. No placement, prominence, byline, credit format, or continued inclusion is promised.
18. Moral Rights and Consent to Modification
To the extent permitted by law, you waive and agree not to assert moral rights, integrity rights, attribution rights, or similar rights that would prevent authorized uses. Where waiver is not permitted, you consent to the modifications, combinations, publication choices, attribution practices, and uses described here. This does not waive rights that law does not allow you to waive.
19. No Automatic Royalties, Joint Ownership, or Partnership
Unless users separately agree in writing, a Contribution does not create royalties, payment, revenue sharing, accounting, approval rights, or ownership of the story as a whole. The Services do not create a partnership, joint venture, employment, fiduciary, agency, or publisher-author relationship. These Terms do not decide whether copyright law independently treats users as joint authors.
20. Contributor and User Representations and Warranties
You represent and warrant that you have authority to submit User Content and grant these permissions; authorized use will not infringe or misappropriate copyright, trademark, trade-secret, privacy, publicity, contractual, confidentiality, or other rights; required releases and consents have been obtained; applicable third-party licenses are followed; no undisclosed royalty, residual, union, guild, collective-management, or payment obligation is created; and the content complies with law and these Terms. You must not falsely claim ownership or disclose confidential information without authority. For fanfiction, these warranties apply only to rights you claim or purport to grant.
21. Withdrawal, Rejection, and Merge Finality
An eligible unmerged Contribution may be withdrawn while withdrawal is available. Owners may reject Contributions. Once merged or directly published into the canonical story, a Contribution cannot be withdrawn in a way that revokes the Section 15 license. Removal requests are discretionary unless law requires otherwise, and historical, security, audit, moderation, and legal records may remain.
22. Story Ownership Transfers
MobWriter does not currently offer self-service story ownership transfers. Collaborator and Editor roles grant only displayed permissions and do not transfer ownership. If a transfer is later supported, it may require verification, consent, additional terms, and preservation of contributor licenses and records. A platform record change would not itself transfer copyrights that require a separate written assignment.
23. Feedback
If you provide ideas, suggestions, or feedback about the Services, you grant MobWriter a worldwide, perpetual, irrevocable, non-exclusive, royalty-free, sublicensable, and transferable license to use and commercialize it without restriction, attribution, or compensation. Do not submit confidential feedback.
24. Acceptable Use
You may not use the Services to violate law or rights; exploit or endanger minors; threaten, harass, stalk, defame, or dox others; distribute nonconsensual intimate material or sexual content involving minors; impersonate deceptively; facilitate fraud; upload malware; spam; evade access, age, moderation, or security controls; scrape or automate access without permission; overload or disrupt the Services; reverse engineer where prohibited; manipulate engagement; expose private stories, personal data, credentials, or vulnerabilities without authorization; or help others do these things.
25. Moderation and Enforcement
We may investigate, preserve evidence, label, restrict visibility or features, reject or remove content, limit distribution, suspend or terminate accounts, and refer matters to authorities when reasonably necessary to enforce these Terms, protect users or the Services, address risk, or comply with law. Moderation may be incomplete or mistaken. We do not promise advance notice, an appeal, or a particular outcome, though notice or review may be provided where appropriate or required.
26. No Obligation to Monitor and No Endorsement
MobWriter is not required to monitor all User Content or conduct and does not endorse, verify, or guarantee it. Users may encounter inaccurate, offensive, unlawful, or objectionable material. Reporting tools do not create a duty to act in a particular way except as required by law.
27. Copyright and DMCA
MobWriter responds to valid notices and counter-notices under 17 U.S.C. § 512. Designated agent: Alden Molina. Address: 1525 Buck Trail Lane, Worthington, OH 43085. Email: contact@mobwriter.com. Notices must identify the work and material, provide contact information, include required good-faith, accuracy, authority, perjury, and signature statements, and should consider fair use. Counter-notices must identify removed material and location, provide contact information, include required mistake, jurisdiction, service, perjury, and signature statements. MobWriter may forward a complete counter-notice and may restore material after the statutory period absent notice of a qualifying court action. See /copyright.
28. Repeat Infringers
In appropriate circumstances, MobWriter will terminate repeat copyright infringers and may restrict or terminate accounts for serious or repeated infringement. We may consider notices, counter-notices, retractions, court decisions, patterns, and other relevant facts. We do not treat every allegation as conclusive and reserve reasonable discretion consistent with law.
29. Other IP Complaints
For trademark, publicity, impersonation, or other intellectual-property concerns not covered by the DMCA, contact [LEGAL EMAIL] with identification of the right, material and location, contact details, basis, and supporting documentation. We may request verification and forward the complaint to the affected user.
30. Account Suspension and Termination
You may stop using the Services at any time. We may suspend, restrict, or terminate access for a breach, legal or security risk, future unpaid charges, extended inactivity, operational needs, or legal compliance. We may provide notice and an opportunity to cure where reasonable but need not do so for urgent, serious, repeated, or legally sensitive matters. Provisions that should survive by their nature will survive.
31. Account Deletion and Retained Records
You may request deletion through available controls. Deletion may remove or anonymize profile and account data, but does not revoke Merged Contribution licenses or require deletion of canonical versions. We may retain or anonymize Terms acceptances, contribution and version history, attribution, moderation, security, copyright, transactional, backup, legal, fraud-prevention, dispute, and enforcement records. Third-party copies and caches are outside our control.
32. Service Changes, Availability, and Discontinuation
We may add, change, limit, suspend, or discontinue features or the Services. We do not guarantee that a feature, content, account, or data will remain available, be compatible with every device, or operate without interruption. Where reasonably practicable, we may give advance notice of material discontinuation.
33. User Backups and Risk of Content Loss
You are responsible for independent copies of important content. The Services are not an archival or backup service, and content may be lost, corrupted, changed, removed, or inaccessible. Any export feature may be limited and is not guaranteed.
34. Beta and Experimental Features
Beta, preview, experimental, or early-access features may be incomplete, changed, or withdrawn without notice and may have additional terms. Use them at your own risk and do not rely on them for critical work.
35. Third-Party Services and Links
The Services may rely on or link to third-party hosting, authentication, storage, analytics, email, and websites. We do not control or take responsibility for their content, security, availability, or practices. Separate terms and policies may apply.
36. Indemnification
To the fullest extent permitted by law, you will defend, indemnify, and hold harmless MobWriter, [LEGAL COMPANY NAME], and their owners, affiliates, officers, directors, employees, contractors, licensors, and agents from claims, proceedings, damages, judgments, losses, liabilities, costs, and reasonable attorneys' fees arising from User Content, misuse, breach, rights violations, unlawful conduct, or user disputes. This does not apply to the extent a claim results from an indemnified party's fraud, willful misconduct, or liability that cannot lawfully be limited. We may control the defense and settlement, and you will cooperate.
37. Disputes Between Users
MobWriter is not a party to disputes involving story ownership or transfer, Contributions, attribution, editing, removed material, collaboration roles, harassment, compensation, royalties, confidentiality, contracts, or off-platform exploitation. Users must resolve private agreements directly. We may take platform action without deciding ultimate legal rights. To the fullest extent permitted by law, you release the Section 36 protected parties from claims arising solely from dealings with another user, excluding MobWriter's own conduct, liability that cannot be released, and rights that cannot be waived.
38. Disclaimers
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” MOBWRITER DISCLAIMS EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, AND WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, ACCURATE, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS; THAT CONTENT WILL BE PRESERVED; OR THAT USER CONTENT IS LAWFUL, ACCURATE, OR NON-INFRINGING. MANDATORY RIGHTS REMAIN.
39. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, MOBWRITER AND THE OTHER INDEMNIFIED PARTIES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR LOST PROFITS, REVENUE, GOODWILL, DATA, CONTENT, OR BUSINESS OPPORTUNITY, EVEN IF ADVISED OF THE POSSIBILITY. TOTAL AGGREGATE LIABILITY WILL NOT EXCEED THE GREATER OF AMOUNTS PAID TO MOBWRITER DURING THE PRIOR 12 MONTHS OR [LIABILITY CAP AMOUNT]. These limits do not apply to liability that cannot lawfully be limited.
40. Informal Dispute Resolution
Before filing suit, you and MobWriter agree to try in good faith to resolve the dispute for [INFORMAL RESOLUTION PERIOD]. Send notice to [LEGAL EMAIL] and [BUSINESS MAILING ADDRESS] describing the account, dispute, facts, and requested relief. This does not prevent urgent injunctive relief, qualifying IP filings, eligible small claims, or action before a limitations period expires. These Terms do not require arbitration and do not waive a jury trial or class proceeding.
41. Governing Law and Venue
Except where the law where you live requires otherwise, Ohio law governs without regard to conflict rules. Subject to mandatory law and Section 40, state and federal courts in Franklin County, Ohio have exclusive jurisdiction. This does not deprive consumers of non-waivable protections or a required forum.
42. Changes to Terms
We may revise these Terms, post a new version and effective date, preserve prior versions, and communicate material changes electronically. Changes generally apply prospectively. Existing contribution licenses remain governed by the version accepted for the legally significant action unless a valid later agreement changes them. We may require acceptance before future significant actions. Where law requires separate consent, we will request it. Continued use constitutes acceptance only where permitted by law.
43. Electronic Communications and Notices
You agree to receive communications by email, account notification, in-app notice, website posting, or another reasonable electronic method. Electronic communications satisfy writing requirements only where law permits. Keep contact information current. We may send service, security, legal, moderation, and transactional messages even when optional marketing is disabled. Routine support messages are not legal notice.
44. Assignment
You may not assign these Terms or transfer your account without written consent. MobWriter may assign these Terms with a merger, acquisition, financing, reorganization, asset sale, affiliate transfer, change of control, similar transaction, or operation of law. Story ownership remains governed by Section 22. Assignment does not expand existing rights.
45. General Contract Terms
These Terms and incorporated policies are the entire Services agreement. Conflict order is: a separately signed agreement expressly overriding these Terms; applicable feature-specific terms; these Terms; then incorporated policies. Unenforceable provisions are narrowed or severed, the remainder continues, and non-enforcement is not waiver. Headings do not control. English controls translations where permitted. MobWriter is not liable for delay beyond reasonable control. Use does not create employment, partnership, agency, joint venture, franchise, or fiduciary duties. Section 36 through 39 protected parties may enforce those provisions. You must comply with applicable sanctions, export restrictions, and embargoes. Licenses, contribution rights, records, warranties, indemnification, disclaimers, liability limits, disputes, IP provisions, retention, and general terms survive as appropriate.

47. Incorporated and Related Policies
The Privacy Policy (/privacy) and Copyright Policy (/copyright) are incorporated to the extent they apply. The Help Center (/help) explains features but does not amend these Terms unless it expressly says so. Community Guidelines, a standalone Acceptable Use Policy, Cookie Notice, Fanfiction Policy, and NSFW Content Policy may be future documents and are not binding unless published, expressly incorporated, and made available.
